Town Officers/Powers of the Select Board

Section 1

The Select Board shall have the general direction and management of the property and affairs of the town in all matters not otherwise provided for by law or these by-laws.

Section 2

It shall be the duty of the Select Board to sell, after first giving notice of the time and place of sale by posting such notice of sale in three convenient and public places in the Town fourteen days at least before the sale, properties taken by the Town under tax title procedure, provided that the Select Board or whomsoever they may authorize to hold such public sale, may reject any bid which they deem inadequate and that the Select Board are authorized to execute and deliver a deed or deeds. Failure of notice to not affect the validity of the sale or deed and to be conclusive with the notice hereinabove provided for.

Section 3

  • The Select Board may sell or otherwise dispose of obsolete personal property belonging to the Town, providing that no such property with an estimated value of five hundred dollars, or more, shall be sold unless proposals for the same shall have been invited by advertisement in a newspaper of general circulation in the Town of Rutland.
  • All contracts issued by the Select Board for the procurement of supplies, services, or real estate and for disposing of supplies or real estate shall conform to the provisions of the Uniform Procurement Act of 1989. (amended 2/19/91)
  • The Select Board is hereby authorized to establish rules and regulations relative to power boats on lakes, ponds, and rivers in the Town of Rutland: (see Town Regulations)

Section 4

The Select Board shall annually appoint an Inspector of gas piping and gas appliances in accordance with Chapter 25, General Laws, as amended.

Section 5

The Select Board is authorized under M.G.L., Ch. 41, Section 23 to appoint a Town Administrator for a term of 1 (one) or 3 (three) years, to establish the duties and responsibilities of said administrator and to take all other action as deemed necessary under the said statue.
