October 26th Special Town Meeting Warrant
SPECIAL TOWN MEETING
Monday, October 26, 2015

Worcester, ss.
To either of the Constables of the Town of Rutland in the County of Worcester:
In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and in Town affairs, to meet at the GLENWOOD ELEMENTARY SCHOOL in said Rutland on Monday, the TWENTY-SIXTH day of October 2015, at 7:00 o’clock in the evening there and then to vote on the following articles:
ARTICLE 1:
To see if the Town will vote to make available beginning in fiscal year 2016, a Senior Citizen Property Tax Work-off Abatement Program approved by acceptance of MGL c.59, §5K under Article 28 of the May 15, 2010 Annual Town Meeting; or take any action in relation thereto.
ARTICLE 2:
To see if the Town will vote to raise and appropriate, transfer from available funds or otherwise provide the sum of $14,839.45 to fund the Town’s portion of the retirement benefit due a Wachusett Regional School District employee in accordance with Section 18 of the Amended Wachusett Regional School District Agreement; or take any action in relation thereto.
ARTICLE 3:
To see if the Town will vote to raise and appropriate, transfer from available funds or otherwise provide such sums of money as may be necessary to purchase and equip a used dump truck with plow and sander for the DPW; or take any action in relation thereto.
ARTICLE 4:
To see if the Town will vote to raise and appropriate, transfer from available funds or otherwise provide the sum of $66,390 to fund Glenwood School roof repairs and required additional roof work; or take any action in relation thereto.
ARTICLE 5:
To see if the Town will vote to raise and appropriate, transfer from available funds or otherwise provide such sums of money as may be necessary to fund repairs to the Fire Department’s Fire Pumper; or take any action in relation thereto.
ARTICLE 6:
To see if the Town will vote to raise and appropriate, transfer from available funds or otherwise provide a sum of money to be added to the Elections Wages Account (162-5110) and Elections Purchased Services Account (162-5200) to pay for costs incurred at the September 16, 2015 Special Town Election; or take any action in relation thereto.
ARTICLE 7:
To see if the Town will vote to raise and appropriate, transfer from available funds or otherwise provide the sum of $8,294 to be added to the Police Wages Account (210-5120); or take any action in relation thereto.
ARTICLE 8:
To see if the Town will vote to amend the fiscal year 2016 elected Town Clerk salary fixed at the Annual Town Meeting of May 9, 2015 in accordance with Chapter 41, Section 108 of the General Laws as amended, by raising and appropriating, transferring from available funds or otherwise providing a sum of money to be added to the Town Clerk Salary Account (161-5110); or take any action in relation thereto.
ARTICLE 9:
To see if the Town of Rutland will vote to accept the provisions of Massachusetts General Law chapter 64L, section 2(a) to impose a local meals excise; or take any action in relation thereto.
ARTICLE 10:
To see if the Town will vote to raise and appropriate, transfer from available funds or otherwise provide an additional sum of $292,195 for the revised fiscal year 2016 Wachusett Regional School District Operations Assessment of $1,642,835; this additional assessment being an increase over the amount of $1,350,640 that was voted and accepted at the August 3, 2015 Special Town Meeting; or take any action in relation thereto.
ARTICLE 11:
To see if the town will vote to authorize the Select Board to acquire by gift and accept a permanent sewer easement at 1 Christmas Tree Lane as follows: the property shown on a Plan of Property surveyed by Quinn Engineering, Inc. for the Rutland D.P.W and bounded and described as follows: BEGINNING at a point on the southerly side of Christmas Tree Lane, said point being 4.62 feet easterly of the Northeasterly corner of the property of the Grantor referenced above; THENCE South 20°27’27” East a distance of 139.52 feet to a point at the southerly boundary of the Grantors property; THENCE North 61°58’55” East a distance of 21.18 feet to a point; THENCE North 20°27’27” West a distance of 139.52 feet to the southerly line of Christmas Tree Lane; THENCE South 61°58’55” West a distance of 20.18 feet to the place of the beginning, a draft of which is available at the Town Clerk's office; or take any action in relation thereto.
ARTICLE 12:
To see if the Town will vote to authorize the Board of Selectmen to negotiate and enter into a Tax Agreement for payments-in-lieu-of-taxes (“PILOT") pursuant to M.G.L. Chapter 59, Section 38H(b), and Chapter 164, Section 1, and any other enabling authority with Golden Hills Solar, LLC, its affiliate or assignee, for a term of up to 20 years and upon such other terms and conditions as the Board shall deem in the best interest of the Town, for both real property and personal property associated with construction and operation of a solar renewable energy generation facility, on a parcel of privately-owned land (Map 31 Lot A7) on Swartz Ave., upon which such facility is to be located, or upon another parcel of land upon which such facility may
be constructed or operated; and, further, to authorize the Board of Selectmen to take all actions necessary to implement such agreement; or take any other action relative thereto.
ARTICLE 13:
To see if the Town will vote to authorize the Board of Selectmen to negotiate and enter into a Tax Agreement for payments-in-lieu-of-taxes (“PILOT") pursuant to M.G.L. Chapter 59, Section 38H(b), and Chapter 164, Section 1, and any other enabling authority with Community Energy Solar, LLC, its affiliate or assignee, for a term of up to 20 years and upon such other terms and conditions as the Board shall deem in the best interest of the Town, for both real property and personal property associated with construction and operation of a solar renewable energy generation facility, on a parcel of privately-owned land (Map 32 Lot B4) on Kenwood Court, upon which such facility is to be located, or upon another parcel of land upon which such facility may be constructed or operated; and, further, to authorize the Board of Selectmen to take all actions necessary to implement such agreement; or take any other action relative thereto.
ARTICLE 14:
To see if the Town will vote to raise and appropriate, appropriate from available funds or otherwise provide a sum of money to be added to the Reserve Fund (132-5700); or take any action in relation thereto.
And you are directed to serve this warrant, by posting up attested copies thereof at five (5) places in said Town, fourteen (14) days at least before the time of holding said meeting.
HEREOF FAIL NOT, and make due return of this warrant, with your doings thereon, to the Town Clerk, at the time and place of meeting, as aforesaid.
