Special Town Meeting, Warrant November 17th at 7:00 PM
The Commonwealth of Massachusetts     
Worcester  SS.

To either of the Constables of the Town of Rutland in the County of Worcester.
IN THE NAME OF The Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and in Town affairs, to meet at the
GLENWOOD ROAD ELEMENTARY SCHOOL AUDITORIUM
in said Rutland on MONDAY, the Seventeenth Day of November, 2014
at 7:00 o’clock in the evening,
then and there to act on the following articles:---


ARTICLE 1:
To see if the Town will accept the donation of flags from a Rutland Girl Scout Troop; or take any action in relation thereto.

ARTICLE 2:
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free Cash) a sum of money to be added to the Wachusett Regional School District Assessment Account (#300-5600); or take any action in relation thereto.

ARTICLE 3:
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free Cash) a sum of money to be added to the Worcester Regional Retirement System Account (# 911-5100); or take any action in relation thereto.

ARTICLE 4:
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free Cash) a sum of money to be added to Legal Services Account (#151-5200); or take any action in relation thereto.

ARTICLE 5:
To see if the Town will vote to Raise and appropriate or appropriate from Available Funds (Free Cash) a sum of money to be added to the Board of Health Rabies Control Account (510-5750); or take any action in relation thereto.

ARTICLE 6:
To see if the Town will vote to appropriate from Available Funds (Sewer Free Cash) a sum of money for the engineering of the proposed sewer line for Forest Hill Dr. and Christmas Tree Lane, said sum to be reimbursed to the sewer enterprise fund via betterment charges; or take any action in relation thereto.

ARTICLE 7:
To see if the Town will vote to appropriate from Available Funds (Sewer Free Cash) a sum of money to furnish and install a Mission M110 cellular, web based SCADA (Supervisory Control and Data Acquisition) type dialer at the Miles Rd. and Valley View pump stations; or take any action in relation thereto.




ARTICLE 8:
To see if the Town will vote to appropriate from Available Funds (Sewer Free Cash) a sum of money to perform up to 31,000 linear feet of infiltration investigation in Subarea 2 (eastern section of town  from Main St. at Glenwood Rd. to Naquag St.; or take any action in relation thereto.

ARTICLE 9:
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free Cash) a sum of money to add to the Treasurer’s Additional Wages Account (#145-5130); or take any action in relation thereto.

ARTICLE 10:
To see if the Town will vote to Raise and Appropriate or  appropriate from Available Funds (Free Cash) a sum of money to the Animal Control Officer Wage Account (292-5110) contingent upon a favorable vote from Regional A.C.O. member towns; or take any action in relation thereto.  

ARTICLE 11:
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free Cash) a sum of money to repair or replace the hot water system in the Public Safety Building; or take any action in relation thereto.   

ARTICLE 12:
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free Cash) a sum of money for repairs to the Fire Department Ladder Truck; or take any action in relation thereto.

ARTICLE 13:
To see if the Town will vote to authorize the Board of Selectmen/ Fire Chief to declare a 1980 Maxim Fire Truck as Surplus Equipment and to authorize the Board of Selectmen/ Fire Chief to dispose of such truck; or take any action in relation thereto.

ARTICLE 14:
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free Cash) a sum of money to replace computer workstations including software required; or take any action in relation thereto.

ARTICLE 15:
To see if the Town will vote to transfer a sum of money from the Overlay Surplus Account to the Assessors Purchased Services Account (141-5200) for Assessing Services; or take any action in relation thereto.   

ARTICLE 16:
To see if the Town will vote to transfer a sum of money from the Admin. Assessor Account (141-5120) to the Assessors Purchased Services Account (141-5200) to be used for Assessing Services; or take any action in relation thereto.  

ARTICLE 17:
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free Cash) a sum of money to pay the consulting fee to evaluate positions in relation to the town salary matrix; or take any action in relation thereto.




ARTICLE 18:
To see if the Town will vote to amend the Town of Rutland General Bylaws by deleting the section entitled “Animal Control Bylaw” (Sections 1-9) adopted at the November 13, 2012 Special Town Meeting and inserting in its place, a new section entitled “Animal Control Bylaw”, a copy of which is on file and available for viewing in the office of the Town Clerk; or take any action in relation thereto.

ARTICLE 19:
To see if the Town will vote to amend the Town of Rutland General Bylaws, Non-Criminal Disposition, Chart section, entitled Description of bylaw, rule or regulation by deleting “Failure to license your dog after April 1 of any given year” and replacing it with “Failure to license your dog by March 31 of any given year”; or take any action in relation thereto.

ARTICLE 20:
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free Cash) a sum of money to add to the Town Clerk Purchased Services Account (161-5200) to pay the annual fee to host and support a new dog licensing program; or take any action in relation thereto.

ARTICLE 21:
To see if the town will vote to amend the Agriculture Commission By-law as follows;
  • To remove and replace “There is hereby established an Agricultural Commission which shall consist of five (5) members and three (3) alternates appointed by the Board of Selectmen, all of whom shall be residents of the Town of Rutland,”
with: “There is hereby established an Agricultural Commission which shall consist of five (5) members and five (5) alternates appointed by the Board of Selectmen, all of whom shall be residents of the Town of Rutland. ~

  • To add “Alternate members for a term of (1) year.”
Or take any action in relation thereto.

ARTICLE 22: (Resident’s Petition)
To see if the town will vote to add a new section, sequentially numbered to the General By-laws of the town of Rutland entitled “Door to Door Solicitation and Canvassing”, a copy is available at the office of the Town Clerk; or take any action in relation thereto.

ARTICLE 23: (Resident’s Petition)
To see if the town will vote to add a new section “Civil Fingerprinting Bylaw”, sequentially numbered, to article___ of the General By-laws of the town of Rutland; a copy is available at the office of the Town Clerk; or take any action in relation thereto.

ARTICLE 24:
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free cash) a sum to money to be added to the Network Account (155-5200); or take any action in relation thereto.






ARTICLE 25:
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free cash) a sum of money to add to the Town Administrator Purchased Services Account (129-5200); or take any action in relation thereto.   

ARTICLE 26:
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free cash) a sum of money to add to the Town Administrator Supply Account (129-5200); or take any action in relation thereto.

ARTICLE 27:
To see if the Town will vote to Raise and Appropriate or  appropriate from Available Funds (Free Cash) a sum of money to purchase Tasers for the Police Department; or take any action in relation thereto.

ARTICLE 28:  
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free cash) a sum to money to be added to the Reserve Fund (#132-5700); or take any action in relation thereto.

ARTICLE 29:
To see if the Town will vote to amend the assessment for the Southern Worcester County Regional Vocational  School District for Fiscal year beginning July 1, 2014 (#300-5600-003); or take any action in relation thereto.

ARTICLE 30:
To see if the Town will vote to Raise and Appropriate, Appropriate from Available Funds (Free Cash), or borrow a sum of money to rent, lease to own, or purchase a Front Loader for the DPW and to authorize the Selectmen/DPW Superintendent to trade in or dispose of the old front loader; or take any action in relation thereto.

ARTICLE 31:
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free Cash) a sum of money to the Police Department Wage Account (#210-5120) to hire a full-time officer effective December 1, 2014 to June 30,2015; or take any action in relation thereto.  

ARTICLE 32:
To see if the Town will vote to Raise and Appropriate or appropriate from Available Funds (Free cash) a sum to money to be added to the Health Insurance Account (914-5100); or take any action in relation thereto.

ARTICLE 33:
To see if the Town will vote to appropriate from Available Funds (Free Cash) a sum of money to offset the fiscal year 2015 tax rate; or take any action in relation thereto.

ARTICLE 34:
To see if the Town will vote to appropriate from Available Funds (Free Cash) a sum of money to the Stabilization Fund; or take any action in relation thereto.







And you are directed to serve this warrant, by posting up attested copies thereof at five (5) places in said Town, fourteen (14) days at least before the time of holding said meeting.         
HEREOF FAIL NOT, and make due return of this warrant, with your doings thereon, to the Town Clerk, at the time and place of meeting, as aforesaid.
