§1 Establishment, Purpose
(A) An Earthworks Board (“Board”) is hereby established in the Town of Rutland (“Town”), the purpose of which is to regulate alteration of earth located within the Town and to administer and enforce any such applicable by-law.
§2 Composition, Appointment, Term of Office
(A) The composition of the Board shall be as follows:
1. One member of the Conservation Commission
2. One member of the Board of Health
3. One member of the Planning Board
4. One member of the Agricultural Commission
5. One at-large member who shall be a registered voter of the Town.
(B) Each Board member shall be appointed by the Select Board; provided, however, that Service on the Board by a member of the Conservation Commission, Board of Health, Planning Board, and Agricultural Commission shall be ex officio only, and any such appointment shall terminate immediately upon the expiration of their term on such multiple-member body or sooner vacating of office.
(C) The at-large member shall be appointed to serve a three-year term; other members shall be appointed to provide, as far as possible, for the terms of not more than two members to expire each year.
(D) Vacancies shall be filled under §2(B) in such manner as to maintain staggered terms.
(E) The members of the Board shall serve without compensation.
(A) The Board shall elect a Chairman and Vice Chairman, and shall choose a Secretary.
(B) The Secretary need not be a member of the Board, and, if not a member of the Board, shall receive only such compensation as may be appropriated therefor by Town Meeting.
(C) The Secretary shall keep a true record of the proceedings of the Board which shall be public records.
§4 Meeting Frequency
(A) The Board shall determine the frequency and times of its meetings.
