 RUTLAND ZONING BOARD OF APPEALS

Present:        Richard Surrette, Chair

        Opening of meeting by the Chairman:    
                Richard Surrette opened the meeting at 6:36 pm.

Acceptance of Minutes:     Chris Senecal motioned to approve of the minutes of April 24, 2014. Richard Surrette seconded. Motion made and seconded. Vote was unanimous.

The Board of Appeals will be referred to as the “Board”.

Public Hearings:

   Robert & Corrine Puliafico, 1 Edson Place, P.O. Box 3, Rutland, MA
  is seeking a Variance to add a third apartment in the basement of an existing duplex      
          located at 11A & 11B Sunnyside Avenue.

              Voting members: Richard Surrette, Chris Senecal, Paul Kirrane

           Mr. & Mrs. Puliafico were present.
           Thomas & Barbara Ruchala, 25 Maple Avenue
           Ruth Lowe, 14 Edson Avenue

The Board discussed the issue of which Zoning District this property is in.  Is it Residential or Town Center District?  The Board reviewed the Zoning Map. Richard Surrette will contact the Board of Selectmen to request permission to seek Town Counsel’s opinion on which district this property is in.  Also, the ZBA will send a memo to the Building Department requesting a memo clarifying which district this property is in.

The petitioner is requesting the Variance due to Mr. Puliafico’s declining health.

The Board reviewed the memo from the Board of Health. They had no issues at this time.  
        The hearing was continued to November 13, 2014 @ 6:30 p.m.

Kenneth Babineau, 116-C Houghton Road, Princeton, MA 01541 is seeking a
Special Permit to install a 80’ x 20’ concrete slab to include a shed and dog  
kennel on the property of 4 Paddock Road, Rutland, MA.

        Voting members:  Richard Surrette, Chris Senecal, Paul Kirrane

        Laura Pease, Animal Control Officer was present.
        Mr. Babineau was present.
Abutters present: Paul Miller, Susan Hall, 342 E. County Road, did not express any concerns with proposed Special Permit.

The petitioner is seeking to construct a 80’ x 20’ concrete slab to include a dog kennel and storage area of 20’ x 60’. The kennel will be for three dogs that are personally owned by Mr. Babineau.  The dogs will not be used for commercial purposes.  

The Animal Control Officer, Laura Pease, spoke with the Board and petitioner about her concerns:  nuisance barking, location of kennel. The petitioner stated that the dogs have bark collars and the kennel will be located where there is heavy woods on both sides of property. After discussion, the proposed dog kennel/storage area does not appear that it will be a nuisance or  health hazard.

Richard Surrette made a motion to grant the Special Permit. Chris Senecal seconded.  Motion made and seconded.  Vote was unanimous to grant the Special Permit.
