            Present:   Richard Surrette, Chair 
                           Chris Senecal, Vice-Chair
                           Robert Paulsen, Member
                           Paul Kirrane, Associate Member

Absent:         Arthur Wells, Associate Member


        Opening of meeting by the Chairman:    
                Richard Surrette opened the meeting at 6:39 pm.

Acceptance of Minutes:     Chris Senecal motioned to approve the minutes of September 25, 2015. Paul Kirrane seconded. Motion made and seconded. Vote was unanimous.

The Board of Appeals will be referred to as the “Board”.

Public Hearings:

6:30 p.m.

Bear Hill Estates, LLC, 87 Main Street, Rutland, MA is seeking a Variance from the front-yard setback requirements from 30 feet to 10 feet at 29 Clealand Circle, (Lot 9R) Map #44C, Lot #16, Book 44894, Page #95, Rutland, MA.

Voting members:  Richard Surrette, Chris Senecal & Robert Paulsen
       
Present:  George Kiritsy, Mr. Blair’s Attorney
               ***See attached list of abutters present***

Hearing began at 6:54 p.m.

The Board reviewed the memo from the Board of Health. They have no concerns at this time. The Board received no comment from the Planning Board or other Town Department.

Attorney Kiritsy spoke to the Board about the hardship for the 20 foot setback variance request because of the slope of the property and soil conditions.  The lot plans were reviewed.  

A large number of abutters and other interested people attended the hearing to express their opposition to the petition.  Many of the abutters stated that the Petitioner had laid out the plans for the development which were approved by the Town.  Abutters felt that the Petitioner should have to abide by those approved plans.  Several abutters were concerned about the aesthetics of a house to be built with only a10 foot setback. The Town requires a minimum of a 30 foot setback.

Chris Senecal motioned to put this Petition to a vote.  Robert Paulsen seconded. Vote was unanimous.

The Board voted as follows:

Opposed to deny the Variance :  Three           Favor:  None

July 13, 2016 @ 6:45 p.m.

ME Realty, LLC, 605 Hartford Turnpike, Shrewsbury, MA 01545, is seeking Site Plan approval to construct a 36’ X 60’ office/garage building within the current gravel Schoolbus parking area located at
175 E. County Road, Rutland, MA. The building will provide sanitary facilities and a sheltered maintenance/inspection area.  (Map No. 63-A, Lot No. 1.01, Book No. 51887, Page No. 213).
